KM Ragolane Attorneys was established in 2020 with a clear commitment: to provide structured, professional and principled legal services. From inception, the firm focused on clarity, compliance and disciplined legal drafting.

After admission as a Notary Public, KM Ragolane recognised a deeper structural concern. Although South African law recognises multiple matrimonial property regimes, including out of community of property with or without accrual, for many couples, marriage in community of property had effectively become the default position.

This was not always a deliberate legal choice. In many instances, it resulted from limited awareness of alternative regimes and the high costs traditionally associated with obtaining an antenuptial contract. Where access to information and affordable services is constrained, meaningful legal choice becomes restricted.

What Is a Notary Public?

A Notary Public is an attorney who has undergone additional specialised training and has passed a formal notarial examination before being admitted by the High Court of South Africa to perform specialised legal functions.

This additional qualification distinguishes a Notary Public as a legal practitioner with advanced expertise in the preparation, authentication, and certification of important legal documents.

While all Notaries are attorneys, not all attorneys are Notaries. Notarial work is therefore a specialised field within the legal profession.

In the context of antenuptial contracts, the law requires that the contract be executed before a Notary Public in order for it to be registered at the Deeds Office and have legal effect.
