Terms & Conditions

These Terms and Conditions govern the use of the B4 I Do website and services operated under the supervision of K.M. Ragolane Attorneys & Notaries.

By accessing this website or using any services offered through B4 I Do, you acknowledge that you have read, understood, and agree to be bound by these Terms. [REQUIRES ATTORNEY REVIEW]

1. Nature of the Service

B4 I Do provides structured antenuptial contract services to couples within the Republic of South Africa. Services are rendered under attorney and notarial supervision and are subject to South African law. Information provided on this website is for general informational purposes only and does not constitute legal advice unless a formal professional engagement has been established.

2. Client Workspace and Communication

2.1 The Client Workspace

B4 I Do encourages clients to use the private Client Workspace because it provides the most complete view of their matter and available resources. Access to the private Client Workspace is activated only after payment has been successfully received and confirmed by B4 I Do, together with any applicable eligibility or onboarding requirements.

Features within the Client Workspace (such as the Accrual Simulator, Decision Assistant, Legal Dictionary, Real Life Examples, and Business Protection modules) are intended solely as educational and preparatory tools. They do not independently create legal advice, a legal opinion, a formal valuation, a guarantee of outcomes, or a determination of the appropriate matrimonial property regime.

2.2 Chat2Us (Workspace Communication)

Chat2Us is a communication feature within the Client Workspace designed to help clients ask questions and track matter progress securely.

2.3 WhatsApp as an Alternative Channel

Clients who prefer not to use the Client Workspace may use the official B4 I Do WhatsApp channel for appropriate communication, subject to availability and the nature of the matter. B4 I Do uses the official contact details published on the website.

However, WhatsApp does not provide all of the functionality available through the Client Workspace. B4 I Do may require that clients use the Client Workspace, official email, or a formal communication process to complete required information, upload documents, access specific matter records, or issue formal instructions.

WhatsApp and Chat2Us are not emergency services. Messages may not be answered immediately, and response times vary depending on the nature and urgency of the matter. A WhatsApp message does not necessarily constitute a formal legal instruction. [REQUIRES ATTORNEY REVIEW]

2.4 Document Sharing via WhatsApp

While clients may send documents through WhatsApp where permitted, B4 I Do may require documents to be resubmitted through the Client Workspace or official email for verification, record-keeping, security, or professional compliance. Uploading or sending a document through WhatsApp does not automatically mean that the document has been reviewed or verified.

3. Eligibility

Antenuptial contracts must be concluded before the marriage takes place. Clients must complete an eligibility assessment before drafting or consultation services can proceed. Completion of an eligibility check does not constitute acceptance of instruction. B4 I Do reserves the right to decline instructions where the matter falls outside the scope of antenuptial contract services.

4. Consultations & Package Scope

All B4 I Do consultations are conducted virtually. Depending on the package selected and the client's requirements, consultations may be conducted through an available virtual communication method such as Zoom, Microsoft Teams, or WhatsApp. B4 I Do does not provide routine in-person consultation appointments.

Service inclusions and consultation availability depend strictly on the package selected and paid for:

  • Standard: For couples who have already firmly decided on Out of Community of Property Without Accrual. This package provides professional drafting, execution, and registration only. No consultation is included.
  • Premium: For couples seeking professional guidance before deciding between With Accrual and Without Accrual. Includes a dedicated virtual consultation to discuss the implications of these regimes prior to making a decision.
  • Deluxe: For couples whose circumstances involve additional complexity (e.g., business interests, significant assets, specific exclusions). Includes a more comprehensive virtual consultation, preparation, and specific drafting considerations.

5. Accuracy of Information

Clients are responsible for ensuring that all information supplied during eligibility assessments, consultations, and drafting is accurate, complete, and truthful. B4 I Do relies on the information provided by clients. Incorrect, incomplete, or misleading information may affect the validity or enforceability of the antenuptial contract.

6. Execution of the Antenuptial Contract

An antenuptial contract must be executed before the marriage ceremony. Failure to execute the contract prior to marriage will result in the marriage automatically being in community of property unless a court order is obtained after the marriage. [REQUIRES ATTORNEY REVIEW]

6.1 Execution Before a Notary Public

Clients who are able to attend the B4 I Do office may attend in person for the execution of the antenuptial contract before a Notary Public, provided that an execution appointment has been arranged and confirmed in advance.

An in-person execution appointment is an appointment strictly for contract execution and is not an in-person consultation. Any consultation or discussion relating to the matrimonial property regime, drafting considerations, or other legal issues is conducted virtually.

Both parties may sign the antenuptial contract before a Notary Public in the presence of two competent witnesses. Clients who are unable to attend in person may be assisted through applicable execution arrangements, including a Special Power of Attorney where appropriate and legally permissible.

6.2 Special Power of Attorney

Where one or both parties cannot personally appear before a Notary Public, execution may take place by way of a Special Power of Attorney authorising an appointed agent to sign the contract on their behalf.

In such cases, B4 I Do will prepare the Special Power of Attorney together with the draft antenuptial contract, including a confirmatory certificate for authentication before a Notary Public or Commissioner of Oaths. This ensures that the execution remains legally valid and compliant, even where the parties are not physically present.

7. Registration at the Deeds Office

Following execution, the antenuptial contract must be registered at the relevant Deeds Office in accordance with the Deeds Registries Act. Registration must occur within three (3) months of execution. Processing timelines at the Deeds Office are outside the control of B4 I Do and delays may occur due to administrative processes or institutional backlogs. [REQUIRES ATTORNEY REVIEW]

8. Fees and Payment

All fees are payable in full upfront. Work cannot commence, and Client Workspace access will not be activated, until payment has been successfully received and confirmed.

8.1 The 48-Hour Payment Window

Clients are encouraged to complete payment promptly after selecting a package. Temporary package selections and unpaid registrations are subject to an applicable 48-hour payment period. [REQUIRES ATTORNEY REVIEW]

If payment is not received and confirmed within the applicable 48-hour period:

  • The temporary registration or request may expire.
  • The temporary unpaid account or profile may be automatically deleted or deactivated.
  • The package selection and issued invoice may lapse.
  • The client may need to restart the process subject to current pricing.

Generating or requesting an invoice does not lock a package price indefinitely. If a client fails to pay within 48 hours, B4 I Do may require a new invoice based on current pricing. However, if a valid invoice has already been issued and payment is made within the 48-hour period, the amount shown on that invoice will generally be honoured, subject to any obvious error.

8.2 Payment Confirmation

Payment is not considered confirmed merely because a client has initiated a transfer or uploaded a proof of payment. Proof of payment may be subject to verification. Payment confirmation occurs only when funds are successfully received and verified through the applicable B4 I Do process. Once confirmed, the applicable Client Workspace access may be activated.

8.3 Price and Package Changes

B4 I Do may change its package names, descriptions, prices, structures, educational tools, features, or service inclusions from time to time. Changes apply to new package selections and new instructions from the effective date.

Where a client has already selected a package, received an applicable invoice, paid, and had the payment confirmed, the applicable package will be administered according to the accepted instruction and the terms applicable at that time. A package or price change will not automatically rewrite an existing, successfully paid instruction. [REQUIRES ATTORNEY REVIEW]

9. Cancellation and Refunds

A client may cancel their instruction by providing written notice. Where consultation, drafting, or administrative work has already been performed, B4 I Do reserves the right to retain all or part of the fees paid in order to cover work completed and administrative costs incurred. [REQUIRES ATTORNEY REVIEW]

Where a client cancels the mandate or requests a refund, all drafts, documents, templates, and related materials prepared by B4 I Do remain the intellectual property of B4 I Do and K.M. Ragolane Attorneys & Notaries.

Clients may not reproduce, use, circulate, or attempt to register such documents independently or through another service provider.

10. Delivery of Registered Contract

Upon receipt of the registered antenuptial contract from the Deeds Office, our offices will notify the client to arrange collection of the document.

Final registered documents are made available according to the applicable delivery or collection arrangement tied to your specific package. Clients selecting the Standard package may collect the document personally or arrange courier delivery at their own cost. Premium and Deluxe packages include the applicable delivery arrangements where courier delivery is confirmed as part of the package terms.

11. Payment Security Notice

B4 I Do takes the security of client payments seriously. Clients should only use payment instructions, payment facilities, or invoices presented through official B4 I Do systems or official B4 I Do communications.

If an unexpected payment request is received, the client should verify it using the official contact details on the B4 I Do website before making any payment.

B4 I Do will not instruct clients to change banking details through an unsolicited communication. Clients should not rely solely on an informal WhatsApp message to communicate a change in banking or payment details.

12. Client Cooperation

Clients must provide requested documentation and instructions within reasonable timeframes. B4 I Do shall not be responsible for delays arising from the client’s failure to cooperate or provide required information.

13. Customary Marriage Considerations

Where parties intend to marry under customary law, the antenuptial contract must be executed before the customary marriage is regarded as having been concluded. B4 I Do does not provide services in respect of matters where lobola negotiations have already been legally concluded. [REQUIRES ATTORNEY REVIEW]

14. Limitation of Liability

To the fullest extent permitted by law, B4 I Do, K.M. Ragolane Attorneys & Notaries and our partners shall not be liable for any loss, damage, delay, or consequence arising from circumstances beyond reasonable control. Specific drafting considerations and exclusions explored during a consultation are subject to formal legal assessment and the terms of the final ANC. WhatsApp is an external communication service, and B4 I Do cannot control the underlying security, availability, or functionality of the WhatsApp platform. [REQUIRES ATTORNEY REVIEW]

15. Website, Social Media & Promotional Content

B4 I Do utilizes social media (such as Instagram, Facebook, TikTok) and various promotional channels for informational and marketing purposes. Such content may become outdated.

Package names, features, pricing, and service inclusions may be updated from time to time. Older advertisements, social media posts, shared promotional material, cached pages, or screenshots do not necessarily reflect current packages, pricing, or terms. Historical promotional content does not automatically create an entitlement to a previous package or price.

The current B4 I Do website and the applicable official invoice/payment documentation should always be relied upon to determine the current package price and applicable inclusions.

All content on this website remains the intellectual property of B4 I Do unless otherwise stated.

16. Privacy and POPIA Compliance

Personal information is processed in accordance with the Protection of Personal Information Act (POPIA). Clients are encouraged to avoid sending highly sensitive information through ordinary messaging channels where a more appropriate secure document channel (such as the Client Workspace) is available. [REQUIRES ATTORNEY REVIEW]

17. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
